Legal Analysis of Personal Data Protection Following the Enactment of the Personal Data Protection Law

Abstract

The rapid development of digital technology has increased the risk of personal data misuse in Indonesia,
thus leading to the enactment of Law Number 27 of 2022 concerning Personal Data Protection as a comprehensive
legal basis. This study aims to analyze legal regulations, implementation, the effectiveness of law enforcement, as
well as obstacles and efforts in protecting personal data in Indonesia following the enactment of the law. The research
method used is normative legal research with a juridical approach, which examines primary, secondary, and tertiary
legal materials through literature review. The results show that normatively, personal data protection regulations in
Indonesia are quite comprehensive and adopt international principles. However, their implementation still faces
various obstacles, such as suboptimal implementing regulations, weak supervisory institutions, low levels of public
awareness, and limited capacity of law enforcement officers. The effectiveness of law enforcement against personal
data breaches is also less than optimal due to the complexity of digital crime and limited resources. Therefore,
integrated efforts are needed through strengthening regulations and institutions, increasing public digital literacy,
and developing technological security systems to achieve optimal personal data protection in Indonesia.
